The Appellate Division on Monday upheld its previous order of maintaining status-quo over holding the post of general secretary of Bangladesh Film Artistes’ Association, until the High Court settles the dispute over the elections of actress Nasrin Akhter Nipun and actor Zayed Khan for the post.
The Appellate Division also directed Nipun and Zayed to take initiative to dispose of the writ petition filed by Zayed Khan challenging the legality of Election Appeal Board’s decision of electing Nipun for the post, after disqualifying Zayed as candidate on charge of misconduct.
The Election Commission declared Zayed as general secretary in the BFAA election held on January 28.
The High Court bench of Justice Mamnoon Rahman and Justice Khandaker Diliruzzaman is scheduled Tuesday for holding hearing in Zayed’s appeal.
A six-member bench of the Appellate Division issued the directive after disposing of an appeal Nipun filed on February 8 challenging a High Court’s February 7 order of staying her election for the post.
The Appellate Division’s chamber judge after hearing Nipun’s appeal on February 9 stayed the High Court’s order and set full court hearing over the election.
The HC had also asked the election appeal board, headed by film director Sohanur Rahman Sohan, to explain within seven days the legality of its decision disqualifying Zayed’s candidature on the ground of misconduct during the casting of the vote on January 28.
The chamber judge observed that Zayed’s writ petition over the election of BFAA, a private association, was not maintainable.
Lawyer Rokanuddin Mahmud and Mustafizur Rahman Khan appeared for Nipun while Zayed was presented by lawyers Yusuf Hussain Humayun, Ahsanul Karim and Abdul Qaium.
